RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

“Agreement”) is entered into by the undersigned participant (“PARTICIPANT”) in connection with participation in any training program, physical program, exercise program, manual therapy, class, or other event (“TRAINING”) sponsored and/or conducted by Body Moxie, LLC and Christine Wue, including their officers, directors, employees, related companies, successors, assigns, independent contractors, and any other affiliated individuals or entities (collectively, “PROVIDER”).*

1. Assumption of Risk

PARTICIPANT understands that participation in the TRAINING involves physical activity, movement, and exercise, which include inherent risks such as injury, soreness, strain, or in rare cases, more serious harm. PARTICIPANT voluntarily assumes all risks associated with participation in the TRAINING, including but not limited to injury, illness, or death, whether caused by PARTICIPANT’s own actions, the actions of others, or the condition of any facilities or equipment used.

2. Release and Waiver of Liability

In consideration for being permitted to participate in the TRAINING, PARTICIPANT hereby waives, releases, and discharges PROVIDER and its officers, directors, employees, contractors, and affiliates from any and all claims, demands, causes of action, or liability for any injury, death, damage, loss, or expense arising out of or in any way related to PARTICIPANT’s participation in the TRAINING.

This includes, without limitation, any injury or harm caused by the act*

3. Indemnification

PARTICIPANT agrees to indemnify, defend, and hold harmless PROVIDER from and against any and all claims, actions, damages, losses, or liabilities (including reasonable attorneys’ fees and costs) arising from or related to PARTICIPANT’s participation in the TRAINING, including any injury or harm caused by or to third parties.

4. Legal Enforceability

This Agreement is intended to be as broad and inclusive as permitted by applicable law. If any portion of this Agreement is held to be invalid, the remaining provisions shall continue in full force and effect.

5. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any legal action or proceeding arising out of or related to this Agreement or the TRAINING shall be brought exclusively in the courts of San Mateo County, California, and PARTICIPANT agrees to submit to the jurisdiction and venue of such courts.

6. Confirmation of Understanding

By signing below, PARTICIPANT certifies that they have carefully read this Agreement, fully understand its terms, and voluntarily agree to be bound by them. PARTICIPANT acknowledges that they are signing this Agreement freely and voluntarily, without any inducement, and that they have had the opportunity to ask questions or seek legal counsel before signing.
